Israeli Litigation Support for UK Law Firms

Rosenberg Law provides Israeli litigation services to UK law firms and private clients. The firm handles urgent applications, enforcement of English judgments, asset tracing, and complex cross-border disputes requiring Israeli court proceedings.

The firm receives instructions from major law firms worldwide for Israeli litigation matters, including obtaining emergency relief, conducting asset investigations, and enforcing judgments. These referrals from sophisticated legal practices—including Magic Circle firms—reflect confidence in the firm’s capabilities and standards.

Urgent Applications and Interim Relief

Israeli courts grant interim relief to protect parties’ interests before final judgment. The firm handles urgent applications requiring swift action, often on short notice.

Freezing Orders and Writs of Attachment

Israeli courts issue writs of attachment and freezing orders to prevent dissipation of assets pending determination of proceedings. These orders secure assets, prevent disposal or removal, and protect claimants against defendants who might otherwise place assets beyond reach.

Equivalent relief in English proceedings includes freezing injunctions (formerly Mareva injunctions) and third-party debt orders. Israeli attachment orders serve similar protective functions within the Israeli legal system.

Case Example — Freezing Order on Bank Account

The firm applied for and obtained a freezing order on an Israeli bank account. The client held a new will of the deceased who owned the funds. The defendant had obtained probate under an earlier will. The freezing order secured the money pending determination of which will was valid.

Case Example — Injunction on Dividend Payments

The firm obtained an injunction preventing payment of dividends due to outstanding debt owed to an estate. Following the injunction, the firm filed substantive proceedings and negotiated a settlement.

Mandatory and Prohibitory Injunctions

Israeli courts grant both mandatory injunctions (compelling specific action) and prohibitory injunctions (restraining action) to preserve the status quo pending final determination. Interim injunctive relief protects parties’ positions whilst proceedings are resolved.

Appointment of Receivers

Where property requires protection or active management during proceedings, Israeli courts appoint receivers to take control and manage assets. Receiver orders ensure proper administration and prevent deterioration or mismanagement pending resolution.

Enforcement of English Judgments in Israel

Case Example — Enforcement Against Israeli Parent Company

An English IT company held a judgment in England against a UK subsidiary of an Israeli company. When the subsidiary entered insolvency, the English judgment required enforcement against the Israeli parent company. The firm enforced the judgment in Israel, achieving recovery that insolvency of the English entity would otherwise have prevented.

Case Example — Enforcement Following English Divorce

Following divorce proceedings in England, the husband was discovered to be hiding valuable assets in Israel. The firm secured the Israeli assets and enforced the English judgment, ensuring the wife received her entitlement despite the husband’s attempts at concealment.

Asset Tracing and Recovery

The firm traces and recovers assets in Israel, whether for estate administration, insolvency proceedings, or judgment enforcement.

Case Example — Estate Asset Recovery

Following failure of an administrator to act, the firm traced estate assets, secured them via Family Court proceedings, and liquidated them following grant of probate.

Case Example — Insolvency Asset Recovery

Instructed by an English insolvency practitioner to recover an Israeli asset belonging to an English bankrupt, the firm enforced the judgment and forced sale of a luxury property in Netanya.

Taking Over Representation

The firm regularly takes over representation in matters where previous Israeli lawyers has failed to deliver results. This includes matters where lawyers have failed to communicate with clients, failed to progress proceedings over extended periods, failed to comply with instructions or court orders, or ceased practice due to death or illness.

Taking over requires rapid assessment of the existing position, identification of what has gone wrong, and development of strategy to achieve the client’s objectives.

UK solicitors who have lost confidence in their Israeli correspondent lawyers, or whose clients report dissatisfaction with Israeli representation, may instruct Rosenberg Law to take over and progress stalled matters.

Negotiation Parallel to Litigation

The firm believes all measures should be taken during all dispute stages to save time, costs, stress, and mitigate risks. Many disputes can be resolved without court proceedings if approached strategically from the outset.

Even after proceedings commence, negotiation continues parallel to litigation. Court-annexed mediation, judicial encouragement of settlement, and commercial reality often produce negotiated outcomes. The firm pursues settlement discussions whilst maintaining litigation pressure, achieving results that purely adversarial approaches may miss.

Remote Participation Under Regulation 72

International clients and witnesses may be exempt to travel to Israel for court appearance. Regulation 72 of the Israeli Civil Procedure Rules 2018 permits remote testimony via video conference when three conditions are satisfied: (1) attendance would impose genuine hardship; (2) testimony is essential to the case; and (3) the foreign jurisdiction permits cross-border evidence gathering.

English law presents no obstacles to providing video testimony to Israeli courts. Courts have approved remote participation where travel would involve considerable expense and place travellers at risk.

Remote hearings carry the same legal weight as physical appearances. Israeli law requires remote participants to testify from their lawyer’s office, ensuring professional standards and a formal setting. The firm’s London office provides appropriate facilities for clients and witnesses giving evidence to Israeli proceedings.

Case Example — Settlement Offer Review

A client instructed the firm to review a settlement offer recommended by her existing Israeli lawyer as highly favourable. The firm advised against accepting the settlement and recommended continuing to judgment. The eventual judgment awarded the client ten times the amount offered in settlement and her costs.

Second opinions provide independent assessment of case strength, litigation strategy, and settlement proposals. UK solicitors may instruct the firm to review advice their clients have received, particularly before significant decisions such as accepting settlements or abandoning claims.

Israeli Court System

Israeli litigation proceeds through courts with specific jurisdictions:

Magistrates’ Courts handle claims up to specified monetary thresholds and certain subject matter regardless of value.

High Courts hear larger claims at first instance and appeals from Magistrates’ Courts.

Family Courts handle family law matters including divorce, custody, and inheritance disputes.

Supreme Court hears appeals from High Courts and exercises constitutional jurisdiction.

The firm’s lawyers appear regularly before Israeli courts at all levels, including the High Court, Family Court, and Supreme Court. This courtroom experience informs all aspects of the firm’s work, including matters that settle without trial.

Working with UK Law Firms

The firm coordinates effectively with UK instructing solicitors, providing:

Clear communication — Regular updates and explanations of Israeli procedures in terms familiar to English practitioners.

Strategic coordination — Alignment of Israeli proceedings with related English litigation or commercial objectives.

Cost transparency — Fee estimates and regular reporting on costs incurred.

Document handling — Translation, authentication, and apostille services for documents moving between jurisdictions.

Expert evidence — Opinions on Israeli law for English proceedings and on English law for Israeli proceedings.

UK solicitors seeking Israeli litigation support may contact the firm directly for preliminary discussion of their client’s matter.

Fees

The firm’s fees are reasonable, proportionate, and agreed on a case-by-case basis. Fee arrangements are discussed openly at the outset. For urgent applications, the firm can provide estimates before substantive work commences.
